Better understanding of the CCPA for CISOs and IT Executives

“The California Consumer Privacy Act (CCPA) went into effect January 1st of this year and will be enforced effective July 1st. Data protection and breach notification provisions, including those for employees, are now in effect. It’s widely expected that the CCPA – which establishes a number of consumer rights over their information and data – will set the tone for additional privacy regulation across the country. Privacy has become a board issue and certainly a critical topic for CISOs and other security leaders. As the saying goes, ‘you can have security without privacy, but you cannot have privacy without security.’ Consequently, there’s a requirement for ‘reasonable’ security within the CCPA. Other regulations call for reasonable security including the GLBA and the European Union’s GDRP (Article 25 – Data Protection by Design and By Default). With all this regulatory attention on reasonable security, what exactly is ‘reasonable’ security remains ambiguous and there has not been a true ‘legal’ definition of the term. What then should security and privacy leaders convey to the board of directors and the executive leadership team regarding the ‘reasonableness’ of their security program and security practices?
